Equitable Distribution of Property: Union County

Property division can be the most complicated issue in a divorce.

Any assets acquired during a marriage — no matter whose name they are in — may be marital property and subject to equitable distribution. To understand what that means in your divorce, talk to a lawyer at the Caldwell Helder Helms & Robison law firm in Monroe, North Carolina.

In North Carolina courts, equitable distribution is presumed to be a 50/50 split of marital assets. But the court may determine that an unequal division is appropriate under certain circumstances. Some assets — a business, for example — can be difficult to divide.

At Caldwell Helder Helms & Robison, an initial, one-hour consultation with a family law attorney is $250.

Who will keep the family home? If one spouse keeps the family home, the other spouse may receive other property in exchange. You may agree that the best option is to sell the home and split the proceeds. Or one spouse may buy out the other's interest.

What happens to pension benefits, 401(k) accounts, stock options, real estate holdings? All of these assets can be divided individually or the spouses can agree to each take assets of equal value. Liquidating assets just for purposes of division can hurt both spouses.

What if a business has to be divided? Your attorney can help you obtain a fair business valuation and determine ways to divide the business value without destroying the business.
